Shaggag Adventure Trip Contract

Second Party: (the Tourist)

Preamble:

Whereas, Shaggag is a licensed tourism firm (Ministry of Tourism License No. 73103160, dated 6/2/1443)  specialized in organizing adventure trips in the territory of the Kingdom of Saudi Arabia and abroad.

Whereas, the Tourist desires to engage Shaggag to organize and provide a Saudi adventure trip according to the Shaggag program selected by Tourist (the “Trip”). Therefore, the Parties agreed to implement the Trip as follows:

1. The Preamble shall constitute an integral part of this Contract and shall be read and interpreted with all terms and clauses thereof.

2. Shaggag shall organize and provide the Trip, according to the published itinerary and Shaggag terms and conditions. The Trip will be led by a Shaggag guide.

3. Accommodation for the Tourist and participants shall be according to the terms in the itinerary for the selected Trip. Shaggag shall be entitled, where necessary or appropriate in light of the safety and security of Tourist or in case of force majeure, to change, modify and alter the Trip itinerary. In this event, Shaggag shall use reasonable efforts to provide a substitute experience that is equal in class and service.

4. Shaggag acknowledges that the Trip shall be subject to the provisions of an insurance contract signed with a national insurance company (Chubb Arabia Cooperative Insurance Company) for insurance. Shaggag shall insure the participants in the Trip during the period of the trip.

5. Tourist agrees to pay Shaggag the Trip fee per Shaggag’s published price list for the selected Trip and itinerary (“Trip Fee”). The Trip Fee must be paid in full at the time of booking.

6. Tourist may cancel the Trip by electronically contacting Shaggag. All costs incurred in preparing for the Trip by Shaggag shall be deducted from the refund to the Tourist. In the event that the cancellation was issued by Shaggag, and after informing the Tourist electronically, Shaggag is obligated to return the full Trip amount or provide an alternative offer with the same benefits and conditions.

 7. Shaggag shall be entitled to increase the Trip Fee prior to the Trip by notifying Tourist in the event of unexpected, substantial increases in Shaggag’s costs. Tourist shall be entitled to accept the increase or receive a full refund of the Trip Fee paid without any deduction.

 8. Shaggag shall not be responsible for force majeure circumstances that occur during the Trip. Shaggag shall not be responsible for injury, illness or other harm suffered by Tourist (or members of the Tourist’s group) which are beyond Shaggag’s control. Shaggag shall not be responsible for damages arising out of a change or modification to a Trip itinerary due to weather or other circumstances which are beyond Shaggag’s control. Shaggag shall use reasonable efforts to complete the Trip and avoid obstacles as much as possible, Allah forbid.

9. Tourist shall provide Shaggag a copy of each Trip participant’s National or Residence ID or Passport.

10. Shaggag is not responsible and shall not compensate Tourist if Tourist is unable to participate in the Trip in whole or in part due to any of the following cases:

a. The failure or delay of the Tourist in providing Shaggag its governmental documents.

b.In the event that Tourist is not granted an entry visa.

c.Tourist is not present at the scheduled date and time of the Trip for any reason not caused by Shaggag.

 11. Tourist shall comply with and shall not violate any applicable law or regulation in force in the Kingdom of Saudi Arabia during the Trip. In the event of a violation of such regulations or laws by Tourist, the Tourist may be charged and/or held responsible and shall indemnify, release and hold Shaggag harmless from any criminal, civil or judicial responsibility arising out of Tourist’s violation.

 12. In the event of any dispute regarding this contract, the parties agree to attempt to resolve the matter amicably. If the dispute cannot be resolved. The parties agree that the competent court in the city of Al-Khobar shall have exclusive jurisdiction.

 13. The Parties acknowledge that their contact details mentioned in the Contract above shall be valid for notifications.
